The Protection Granted to Refugees in Romania

Abstract


In this study we will extract from the rules concerning the type of protection of the refugee status to be granted to an applicant for asylum in Romania and the necessary conditions to obtain them. We will make an analysis on the forms of protection to understand in detail the differences between them. Thus in the Law no. 122 of 2006 on asylum in Romania there are given exactly three forms of protection that could be offered to an asylum seeker. The legislator may recognize the status of refugee and grant the subsidiary or temporary protection. At the same time it will also be extracted from the existing rules the rights and obligations of beneficiaries of some form of protection. In this regard it will be possible to differentiate between asylum seeker, the beneficiary of a form of protection and a stranger who is not in the above mentioned situations. The difference between the first two categories of persons and the latter presents is presented in the national law, the status of those being regulated separately into separate laws.
